Términos de Servicio

Bienvenido/a a Ambher Home. Los términos "nosotros", "nos" y "nuestro" se refieren a Ambher Home. Ambher Home opera esta tienda y sitio web, incluyendo toda la información relacionada, contenido, funciones, herramientas, productos y servicios, con el fin de ofrecerte a ti, el cliente, una experiencia de compra personalizada (los "Servicios"). Ambher Home funciona con Shopify, que nos permite ofrecerte los Servicios.

Los siguientes términos y condiciones, junto con cualquier política aquí referenciada (estos "Términos de Servicio" o "Términos"), describen tus derechos y responsabilidades al usar los Servicios.

SECCIÓN 1 - ACCESO Y CUENTA

Al aceptar estos Términos de Servicio, declaras que tienes al menos la mayoría de edad en tu estado o provincia de residencia, y que has dado tu consentimiento para permitir que cualquiera de tus dependientes menores use los Servicios en dispositivos que posees, compras o gestionas.

Para usar los Servicios, incluyendo acceder o navegar por nuestras tiendas online o comprar cualquiera de los productos o servicios que ofrecemos, es posible que se te pida cierta información, como tu correo electrónico, información de facturación, pago y envío. Declaras y garantizas que toda la información que proporcionas en nuestras tiendas es correcta, actual y completa, y que tienes todos los derechos necesarios para proporcionar dicha información.

Eres el único responsable de mantener la seguridad de las credenciales de tu cuenta y de toda la actividad de tu cuenta. No puedes transferir, vender, ceder ni licenciar tu cuenta a ninguna otra persona.

Hemos hecho todo lo posible por ofrecer una representación precisa de nuestros productos y servicios en nuestras tiendas online. Sin embargo, ten en cuenta que los colores o la apariencia del producto pueden diferir de cómo aparecen en tu pantalla debido al tipo de dispositivo que usas para acceder a la tienda y a la configuración de tu dispositivo.

No garantizamos que la apariencia o calidad de los productos o servicios que compres coincida con tus expectativas o sea igual a la representada en nuestras tiendas online.

Al realizar un pedido, estás haciendo una oferta de compra. Ambher Home se reserva el derecho de aceptar o rechazar tu pedido por cualquier motivo, a su discreción. Tu pedido no se considera aceptado hasta que Ambher Home confirme su aceptación. Debemos recibir y procesar tu pago antes de que el pedido sea aceptado. Por favor, revisa tu pedido cuidadosamente antes de enviarlo, ya que Ambher Home puede no poder atender solicitudes de cancelación después de que un pedido haya sido aceptado. En caso de que no aceptemos, modifiquemos o cancelemos un pedido, intentaremos notificarte contactando el correo electrónico, dirección de facturación y/o número de teléfono proporcionados al realizar el pedido.

Tus compras están sujetas a devolución o cambio únicamente conforme a nuestra Política de Reembolsos (https://ambherhome.com/policies/refund-policy).

Declaras y garantizas que tus compras son para tu uso personal o doméstico y no para reventa comercial o exportación.

SECCIÓN 4 - PRECIOS Y FACTURACIÓN

Los precios, descuentos y promociones están sujetos a cambios sin previo aviso. El precio cobrado por un producto o servicio será el vigente en el momento en que se realiza el pedido y se indicará en tu correo de confirmación de pedido. Salvo que se indique expresamente lo contrario, los precios publicados no incluyen impuestos, envío, manejo, aduanas o cargos de importación.

Los precios publicados en nuestras tiendas online pueden diferir de los precios ofrecidos en tiendas físicas o en tiendas online o de otro tipo operadas por terceros. Podemos ofrecer, de vez en cuando, promociones en los Servicios que pueden afectar al precio y que se rigen por términos y condiciones separados de estos Términos. Si existe un conflicto entre los términos de una promoción y estos Términos, prevalecerán los términos de la promoción.

Aceptas proporcionar información de compra, pago y cuenta actual, completa y precisa para todas las compras realizadas en nuestras tiendas. Aceptas actualizar con prontitud tu cuenta y demás información, incluyendo tu correo electrónico, números de tarjeta de crédito y fechas de caducidad, para que podamos completar tus transacciones y contactarte según sea necesario.

Declaras y garantizas que (i) la información de la tarjeta de crédito que proporcionas es verdadera, correcta y completa, (ii) estás debidamente autorizado/a para usar dicha tarjeta de crédito para la compra, (iii) los cargos en los que incurras serán honrados por la entidad de tu tarjeta de crédito, y (iv) pagarás los cargos en los que incurras a los precios publicados, incluyendo gastos de envío y manejo y todos los impuestos aplicables, si los hubiera.

SECCIÓN 5 - ENVÍO Y ENTREGA

No somos responsables de los retrasos en el envío y la entrega. Todos los plazos de entrega son estimaciones únicamente y no están garantizados. No somos responsables de los retrasos causados por las empresas de transporte, procesamiento aduanero o eventos fuera de nuestro control. Una vez que transferimos los productos al transportista, el título y el riesgo de pérdida pasan a ti.

SECCIÓN 6 - PROPIEDAD INTELECTUAL

Nuestros Servicios, incluyendo, entre otros, todas las marcas comerciales, marcas, texto, pantallas, imágenes, gráficos, reseñas de productos, vídeo y audio, así como su diseño, selección y disposición, son propiedad de Ambher Home, sus filiales o licenciantes, y están protegidos por las leyes de patentes, derechos de autor y otras leyes de propiedad intelectual aplicables.

Estos Términos te permiten usar los Servicios únicamente para tu uso personal y no comercial. No debes reproducir, distribuir, modificar, crear obras derivadas, mostrar públicamente, ejecutar públicamente, republicar, descargar, almacenar o transmitir ningún material de los Servicios sin nuestro consentimiento previo por escrito. Salvo que se indique expresamente en este documento, nada en estos Términos otorga ni debe interpretarse como el otorgamiento de una licencia u otros derechos sobre cualquier patente, marca, derecho de autor u otra propiedad intelectual de Ambher Home, Shopify o cualquier tercero. El uso no autorizado de los Servicios puede constituir una violación de las leyes de propiedad intelectual aplicables. Los nombres, logotipos, nombres de productos y servicios, diseños y eslóganes de Ambher Home son marcas comerciales de Ambher Home o sus filiales o licenciantes. No debes usar dichas marcas sin el permiso previo por escrito de Ambher Home. El nombre, logotipo, nombres de productos y servicios, diseños y eslóganes de Shopify son marcas comerciales de Shopify. Todos los demás nombres, logotipos, nombres de productos y servicios, diseños y eslóganes en los Servicios son marcas comerciales de sus respectivos propietarios.

SECCIÓN 7 - HERRAMIENTAS OPCIONALES

Es posible que se te dé acceso a herramientas de terceros ofrecidas como parte de los Servicios, que no supervisamos ni sobre las que tenemos control o intervención alguna.

Reconoces y aceptas que proporcionamos acceso a dichas herramientas "tal cual" y "según disponibilidad", sin garantías, representaciones o condiciones de ningún tipo y sin ningún respaldo. No tendremos responsabilidad alguna derivada de o relacionada con tu uso de herramientas opcionales de terceros.

Cualquier uso que hagas de las herramientas opcionales ofrecidas a través del sitio es enteramente bajo tu propio riesgo y discreción, y debes asegurarte de estar familiarizado/a con los términos en que dichas herramientas son proporcionadas por el proveedor tercero correspondiente y de aprobarlos.

También podemos, en el futuro, ofrecer nuevas funciones a través de los Servicios (incluido el lanzamiento de nuevas herramientas y recursos). Dichas nuevas funciones también se considerarán parte de los Servicios y estarán sujetas a estos Términos de Servicio.

SECCIÓN 8 - ENLACES A TERCEROS

Los Servicios pueden contener materiales y enlaces a sitios web proporcionados u operados por terceros (incluida cualquier funcionalidad integrada de terceros). No somos responsables de examinar o evaluar el contenido o la exactitud de ningún material o sitio web de terceros al que decidas acceder. No somos responsables de ningún daño o perjuicio relacionado con tu acceso a sitios web de terceros, ni con tu compra o uso de cualquier producto, servicio, recurso o contenido en dichos sitios. SECCIÓN 9 - RELACIÓN CON SHOPIFY

Ambher Home funciona con Shopify, que nos permite ofrecerte los Servicios. Sin embargo, cualquier venta y compra que realices en nuestra tienda se realiza directamente con Ambher Home. Al usar los Servicios, reconoces y aceptas que Shopify no es responsable de ningún aspecto de las ventas entre tú y Ambher Home, incluyendo cualquier lesión, daño o pérdida resultante de los productos y servicios comprados. Por la presente, liberas expresamente a Shopify y sus filiales de todas las reclamaciones, daños y responsabilidades derivadas de o relacionadas con tus compras y transacciones con Ambher Home.

SECCIÓN 10 - POLÍTICA DE PRIVACIDAD

Al usar los Servicios, reconoces que has leído estas políticas de privacidad.

Debido a que los Servicios están alojados por Shopify, Shopify recopila y procesa información personal sobre tu acceso y uso de los Servicios con el fin de proporcionarte y mejorar los Servicios. La información que envíes a los Servicios será transmitida y compartida con Shopify, así como con terceros que puedan estar ubicados en países distintos al tuyo, con el fin de prestarte servicios. SECCIÓN 11 - COMENTARIOS

Si envías, subes, publicas, escribes por correo electrónico o transmites de otro modo ideas, sugerencias, comentarios, reseñas, propuestas, planes u otro contenido (colectivamente, "Comentarios"), nos concedes una licencia perpetua, mundial, sublicenciable y libre de regalías para usar, reproducir, modificar, publicar, distribuir y mostrar dichos Comentarios en cualquier medio y para cualquier propósito, incluido el uso comercial. Podemos, por ejemplo, usar nuestros derechos bajo esta licencia para operar, proporcionar, evaluar, mejorar y promocionar los Servicios, y para cumplir nuestras obligaciones y ejercer nuestros derechos conforme a los Términos de Servicio.

Podemos, aunque no estamos obligados a ello, supervisar, editar o eliminar Comentarios que determinemos, a nuestra entera discreción, que son ilegales, ofensivos, amenazantes, difamatorios, pornográficos, obscenos u objetables de otro modo, o que violan la propiedad intelectual de cualquier parte o estos Términos de Servicio.

Aceptas que tus Comentarios no violarán ningún derecho de terceros, incluyendo derechos de autor, marca, privacidad, personalidad u otros derechos personales o de propiedad. Además, aceptas que tus Comentarios no contendrán contenido difamatorio o de otro modo ilegal, abusivo u obsceno, ni contendrán ningún virus informático u otro malware que pudiera afectar de cualquier manera el funcionamiento de los Servicios o cualquier sitio web relacionado. No puedes usar una dirección de correo electrónico falsa, hacerte pasar por otra persona, o engañarnos de otro modo a nosotros o a terceros sobre el origen de cualquier Comentario. Eres el único responsable de cualquier Comentario que hagas y de su exactitud. No asumimos ninguna responsabilidad por los Comentarios publicados por ti o por cualquier tercero.

SECCIÓN 12 - ERRORES, INEXACTITUDES Y OMISIONES

Ocasionalmente puede haber información en los Servicios que contenga errores tipográficos, inexactitudes u omisiones relacionadas con descripciones de productos, precios, promociones, ofertas, gastos de envío, tiempos de tránsito y disponibilidad. Nos reservamos el derecho de corregir cualquier error, inexactitud u omisión, y de cambiar o actualizar la información o cancelar pedidos si alguna información es inexacta en cualquier momento sin previo aviso (incluso después de que hayas enviado tu pedido).

SECCIÓN 13 - USOS PROHIBIDOS

Puedes acceder y usar los Servicios únicamente con fines lícitos. No puedes acceder ni usar los Servicios, directa o indirectamente: (a) para cualquier propósito ilícito o malicioso; (b) para violar cualquier normativa, regla, ley u ordenanza local, provincial, estatal, federal o internacional; (c) para infringir o violar nuestros derechos de propiedad intelectual o los de terceros; (d) para acosar, abusar, insultar, dañar, difamar, calumniar, menospreciar, intimidar o perjudicar a cualquiera de nuestros empleados o a cualquier otra persona; (e) para transmitir información falsa o engañosa; (f) para enviar, recibir a sabiendas, subir, descargar, usar o reutilizar cualquier material que no cumpla con estos Términos; (g) para transmitir, o procurar el envío de, cualquier material publicitario o promocional, incluyendo "correo basura", "cadenas de mensajes", "spam" o cualquier otra solicitud similar; (h) para hacerte pasar o intentar hacerte pasar por otra persona o entidad; o (i) para llevar a cabo cualquier otra conducta que restrinja o inhiba el uso o disfrute de los Servicios por parte de otros, o que, según determinemos, pueda perjudicar a Ambher Home, Shopify o a los usuarios de los Servicios, o exponerlos a responsabilidad.

Además, aceptas no: (a) subir o transmitir virus o cualquier otro tipo de código malicioso que pueda afectar la funcionalidad u operación de los Servicios; (b) reproducir, duplicar, copiar, extraer, vender, revender o explotar cualquier parte de los Servicios; (c) recopilar o rastrear la información personal de otros; (d) hacer spam, phishing, pharming o pretexting a los servicios; (e) usar cualquier robot, spider, herramientas de scraping, recopilación y extracción de datos, dispositivos o procesos automáticos, herramientas de IA (como IA agencial) o medios automáticos o manuales para acceder a los Servicios; o (f) interferir, eludir o burlar las funciones de seguridad o autorización, encabezados de exclusión de robots u otras medidas que empleamos para restringir el acceso a los Servicios. Nos reservamos el derecho de suspender, deshabilitar o cancelar tu cuenta en cualquier momento, sin previo aviso, si determinamos que has violado cualquier parte de estos Términos.

SECCIÓN 14 - AGENTES

14.1 Esta sección ("Términos de Agentes") se aplica si usas, permites, habilitas o provocas el despliegue de un Agente para acceder, usar o interactuar con cualquiera de los Servicios. "Agente" significa cualquier software o servicio que realiza acciones autónomas o semiautónomas en nombre de, o por instrucción de, cualquier persona o entidad, y que puede ejecutarse en nombre de o usando el dispositivo de una persona, sin supervisión directa.

14.2 Ningún Agente puede acceder, usar o interactuar con los Servicios a menos que, en todo momento, se identifique a sí mismo y opere en estricto cumplimiento de los requisitos de la sección 14.4 siguiente. Además, ningún Agente puede acceder, usar o interactuar con los Servicios si hemos solicitado que dicho Agente se abstenga de acceder, usar o interactuar con cualquier servicio.

14.3 Podemos limitar, incluso mediante medidas técnicas, si y cómo cualquier Agente accede, usa e interactúa con los Servicios.

14.4 Los Agentes deben: (i) en todas las solicitudes HTTP/HTTPS, identificar que la solicitud proviene de un Agente y revelar el nombre del Agente incluyendo lo siguiente en la cadena user-agent de la solicitud: "Agent/[nombre del agente]"; (ii) no ocultar u ofuscar que cualquier acceso, uso o interacción proviene de un Agente, como (a) imitando patrones de comportamiento e interacción humanos, o (b) completando o eludiendo CAPTCHAs u otras medidas destinadas a distinguir el uso por ordenador del uso humano; (iii) responder con veracidad a cualquier pregunta o solicitud que busque determinar si las interacciones provienen de un humano o de un ordenador; (iv) no eludir ni evitar de otro modo ninguna medida destinada a bloquear, limitar, modificar o controlar si y cómo los Agentes acceden, usan o interactúan con los Servicios.

SECCIÓN 15 - TERMINACIÓN

Podemos rescindir este acuerdo o tu acceso a los Servicios (o cualquier parte de los mismos) a nuestra entera discreción, en cualquier momento y sin previo aviso, y seguirás siendo responsable de todos los importes adeudados hasta la fecha de terminación, inclusive.

Las siguientes secciones continuarán aplicándose tras cualquier terminación: Propiedad Intelectual, Comentarios, Terminación, Exención de Garantías, Limitación de Responsabilidad, Indemnización, Divisibilidad, Renuncia; Acuerdo Íntegro, Cesión, Ley Aplicable, Política de Privacidad, y cualquier otra disposición que por su naturaleza deba sobrevivir a la terminación.

SECCIÓN 16 - EXENCIÓN DE GARANTÍAS

La información presentada en o a través de los Servicios se pone a disposición únicamente con fines informativos generales. No garantizamos la exactitud, integridad o utilidad de esta información. Cualquier confianza que deposites en dicha información es estrictamente bajo tu propio riesgo. Renunciamos a toda responsabilidad derivada de la confianza depositada en dichos materiales por ti o cualquier otro visitante de los Servicios, o por cualquiera que pueda ser informado de su contenido.

SALVO QUE SE INDIQUE EXPRESAMENTE POR AMBHER HOME, LOS SERVICIOS Y TODOS LOS PRODUCTOS OFRECIDOS A TRAVÉS DE LOS SERVICIOS SE PROPORCIONAN "TAL CUAL" Y "SEGÚN DISPONIBILIDAD" PARA TU USO, SIN NINGUNA REPRESENTACIÓN, GARANTÍA O CONDICIÓN DE NINGÚN TIPO, YA SEA EXPRESA O IMPLÍCITA, INCLUYENDO TODAS LAS GARANTÍAS O CONDICIONES IMPLÍCITAS DE COMERCIABILIDAD, CALIDAD COMERCIAL, IDONEIDAD PARA UN PROPÓSITO PARTICULAR, DURABILIDAD, TITULARIDAD Y NO INFRACCIÓN. NO GARANTIZAMOS, REPRESENTAMOS NI ASEGURAMOS QUE TU USO DE LOS SERVICIOS SERÁ ININTERRUMPIDO, OPORTUNO, SEGURO O LIBRE DE ERRORES. ALGUNAS JURISDICCIONES LIMITAN O NO PERMITEN LA EXENCIÓN DE GARANTÍAS IMPLÍCITAS U OTRAS, POR LO QUE LA EXENCIÓN ANTERIOR PUEDE NO APLICARSE A TI.

SECCIÓN 17 - LIMITACIÓN DE RESPONSABILIDAD

EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, EN NINGÚN CASO AMBHER HOME, NUESTROS SOCIOS, DIRECTORES, FUNCIONARIOS, EMPLEADOS, FILIALES, AGENTES, CONTRATISTAS, PROVEEDORES DE SERVICIOS O LICENCIANTES, O LOS DE SHOPIFY Y SUS FILIALES, SERÁN RESPONSABLES DE NINGUNA LESIÓN, PÉRDIDA, RECLAMACIÓN, O DAÑOS DIRECTOS, INDIRECTOS, INCIDENTALES, PUNITIVOS, ESPECIALES O CONSECUENTES DE CUALQUIER TIPO, INCLUYENDO, SIN LIMITACIÓN, PÉRDIDA DE BENEFICIOS, PÉRDIDA DE INGRESOS, PÉRDIDA DE AHORROS, PÉRDIDA DE DATOS, COSTES DE REPOSICIÓN, O DAÑOS SIMILARES, YA SEA BASADOS EN CONTRATO, AGRAVIO (INCLUYENDO NEGLIGENCIA), RESPONSABILIDAD OBJETIVA U OTROS, DERIVADOS DE TU USO DE CUALQUIERA DE LOS SERVICIOS O PRODUCTOS ADQUIRIDOS A TRAVÉS DE LOS SERVICIOS, O DE CUALQUIER OTRA RECLAMACIÓN RELACIONADA DE ALGUNA MANERA CON TU USO DE LOS SERVICIOS O CUALQUIER PRODUCTO, INCLUYENDO, ENTRE OTROS, CUALQUIER ERROR U OMISIÓN EN CUALQUIER CONTENIDO, O CUALQUIER PÉRDIDA O DAÑO DE CUALQUIER TIPO INCURRIDO COMO RESULTADO DEL USO DE LOS SERVICIOS O CUALQUIER CONTENIDO (O PRODUCTO) PUBLICADO, TRANSMITIDO O PUESTO A DISPOSICIÓN DE OTRO MODO A TRAVÉS DE LOS SERVICIOS, INCLUSO SI SE HA ADVERTIDO DE SU POSIBILIDAD.

SECCIÓN 18 - INDEMNIZACIÓN

Aceptas indemnizar, defender y eximir de responsabilidad a Ambher Home, Shopify, y nuestras filiales, socios, funcionarios, directores, empleados, agentes, contratistas, licenciantes y proveedores de servicios de cualquier pérdida, daño, responsabilidad o reclamación, incluyendo honorarios razonables de abogados, pagaderos a cualquier tercero debido a o derivados de (1) tu incumplimiento de estos Términos de Servicio o los documentos que incorporan por referencia, (2) tu violación de cualquier ley o de los derechos de un tercero, o (3) tu acceso y uso de los Servicios.

Te notificaremos de cualquier reclamación indemnizable, entendiéndose que el hecho de no notificar con prontitud no te eximirá de tus obligaciones a menos que se te cause un perjuicio material. Podemos controlar la defensa y el acuerdo de dicha reclamación a tu cargo, incluyendo la elección del abogado, pero no acordaremos ninguna reclamación que requiera obligaciones no monetarias de tu parte sin tu consentimiento (que no será denegado injustificadamente). Cooperarás en la defensa de las reclamaciones indemnizadas, incluyendo proporcionando los documentos relevantes.

SECCIÓN 19 - DIVISIBILIDAD

En caso de que se determine que alguna disposición de estos Términos de Servicio es ilegal, nula o inaplicable, dicha disposición será, no obstante, exigible en la máxima medida permitida por la ley aplicable, y la parte inaplicable se considerará separada de estos Términos de Servicio; dicha determinación no afectará la validez y exigibilidad de las demás disposiciones restantes.

SECCIÓN 20 - RENUNCIA; ACUERDO ÍNTEGRO

El hecho de que no ejerzamos o hagamos cumplir algún derecho o disposición de estos Términos de Servicio no constituirá una renuncia a dicho derecho o disposición.

Estos Términos de Servicio y cualquier política o norma operativa publicada por nosotros en este sitio o respecto al Servicio constituyen el acuerdo íntegro y el entendimiento entre tú y nosotros, y rigen tu uso del Servicio, sustituyendo cualquier acuerdo, comunicación y propuesta previos o contemporáneos, ya sean orales o escritos, entre tú y nosotros (incluyendo, entre otros, cualquier versión anterior de los Términos de Servicio).
